Benjamin was convicted at Norfolk Assizes on 24 March 1832 and sentenced to life transportation, he arrived Sydney aboard Planter on 15 October 1832.

Benjamin was convicted at Maitland on 23 September 1844 of murdering Robert Campbell on 30 May 1844 at Williams River and sentenced to death.
