Timothy arrived Sydney aged 25 aboard Earl St Vincent on 16 December 1818 with his Indent showing alias "Forde" and trade "carpenter".

Timothy with David Brown and Timothy Buckley were convicted on 7 April 1819 of murdering William Cosgrove (district constable) on 1 April 1819 at South Creek and sentenced to death.
