Thomas was convicted at London Gaol Delivery on 11 April 1833.and entrenched to 14 years transportation, he arrived Sydney aboard Aurora on 3 November 1833

Thomas was convicted on 10 March 1841 at Maitland of murder James Stone on 28 July 1841 at Maitland (shooting) and sentenced to death.

Thomas was hanged on 5 April1842 Newcastle.
