James was convicted at Stafford Quarter Sessions on 29 April 1829 and was sentenced to 7 years transportation, he arrived Sydney aboard Prince Regent on 10 January 1830.

James was convicted on 21 December 1835 of murder a fellow inmate John Dursley (Countess Harcourt 1824) at Norfolk Island during August 1835 (with a spade) and sentenced to death.
